<p id="1" class="large-text">Homeowners coverage provides financial protection against loss due to disasters, theft and accidents. Most standard policies include four essential types of coverage: Coverage for the structure of your home; Coverage for your personal belongings; Liability protection; Coverage for Additional Living Expenses</p>

<h2>Coverage for the structure of your home</h2>
<p>Your homeowners policy pays to repair or rebuild your home if it is damaged or destroyed by fire, hurricane, hail, lightning or other disasters listed in your policy. Most policies also cover detached structures such as a garage, tool shed or gazebo—generally for about 10 percent of the amount of insurance you have on the structure of the house.</p>
<p>A standard policy will <em>not</em> pay for damage caused by a flood, earthquake or routine wear and tear.</p>
<p>When purchasing coverage for the structure of your home, remember this simple guideline: Purchase enough coverage to rebuild your home.</p>

<h2>Coverage for your personal belongings</h2>
<p>Your furniture, clothes, sports equipment and other personal items are covered if they are stolen or destroyed by fire, hurricane or other insured disasters. The coverage is generally 50 to 70 percent of the insurance you have on the structure of the house.</p>
<p>The best way to determine if this is enough coverage is to <a target="_blank" href="http://www.iii.org/article/how-create-home-inventory" rel="noopener">conduct a home inventory</a>.</p>
<p>Personal belongings coverage includes items stored off-premises—this means you are covered anywhere in the world. Some companies limit the amount to 10 percent of the amount of insurance you have for your possessions. You also have up to $500 of coverage for unauthorized use of your credit cards.</p>
<p>Expensive items like jewelry, furs, art, collectibles and silverware are covered, but there are usually dollar limits if they are stolen. To insure these items to their full value, purchase a special <a target="_blank" href="https://www.iii.org/article/floaters-and-endorsements-special-coverage-valuables" rel="noopener">personal property endorsement or floater</a> and insure the item for its officially appraised value.</p>
<p><a target="_blank" href="http://www.iii.org/article/trees-and-insurance" rel="noopener">Trees, plants and shrubs are also covered</a> under standard homeowners insurance—generally for about $500 per item. Trees and plants are not covered for disease, or if they have been poorly maintained.</p>

<h2>Liability protection</h2>
<p>Liability covers you against lawsuits for bodily injury or property damage that you or family members cause to other people. It also pays for damage caused by your pets. So, if your son, daughter (or even your dog) accidentally ruins a neighbor’s expensive rug, you are covered. (However, if they destroy <em>your</em> rug, you’re out of luck.)</p>
<p>The liability portion of your policy pays for both the cost of defending you in court and any court awards—up to the limit stated in your policy documents.</p>
<p>Liability limits generally start at about $100,000, however, it’s a good idea to discuss whether you should purchase a higher level of protection with your insurance professional. If you have significant assets and want more coverage than is available under your homeowners policy, consider purchasing an <a target="_blank" href="http://www.iii.org/article/what-umbrella-liability" rel="noopener">umbrella</a> or excess liability policy, which provides broader coverage and higher liability limits.</p>
<p>Your policy also provides no-fault medical coverage, so if a friend or neighbor is injured in your home, he or she can simply submit medical bills to your insurance company. This way, expenses can be paid without a liability claim being filed against you. It does not, however, pay the medical bills for your own family or your pet.</p>

<h2>Additional living expenses (ALE)</h2>
<p>ALE pays the additional costs of living away from home if you cannot live there due to damage from a an insured disaster. It covers hotel bills, restaurant meals and other costs, over and above your usual living expenses, incurred while your home is being rebuilt.</p>
<p>Keep in mind that the ALE coverage in your homeowners policy has limits—and some policies include a time limitation. However, these limits are <em>separate</em> from the amount available to rebuild or repair your home. Even if you use up your ALE your insurance company will still pay the full cost of rebuilding your home up to the policy limit.</p>
<p>If you rent out part of your house, ALE also covers you for the rent that you would have collected from your tenant if your home had not been destroyed.</p>

Make sure they are accurate and report any mistakes immediately. <p><strong>Houses located on or near the coast will generally cost more to insure than those further inland. <p><strong>While earthquakes are most frequently associated with California, they occur in the majority of states and, like flooding, are not covered under standard home insurance policies. These reports provide a record of the type of loss on the home, the date of the loss and the amount and status of each claim—going back five years.  If the report indicates there has been damage to the house, have it checked by a professional.</strong></p>
<p><strong>A home claim history can provide extremely valuable information and should prompt questions from the buyer.  For instance, if there was a claim for water damage on the home, it is important to find out the source of the damage (such as a burst pipe) and whether it has been properly repaired. On the other hand, if there was a claim for wind or hail, which resulted in a new roof, this makes the home stronger and is very attractive from an insurance perspective.   </strong></p>
<p><span style="color: #ff0000;"><strong><em>12. Get the House Inspected</em></strong></span></p>
<p><strong>You’ll need to have the house <em>properly</em> inspected in order to get your mortgage approved. Accompany the inspector and make sure he/she does a thorough inspection of the home. The inspector should:</strong></p>
<ul>
<li><em><strong>Check the general condition of the home</strong></em></li>
<li><em><strong>Look for water damage, termites and other types of infestation</strong></em></li>
<li><em><strong>Review the electrical system, plumbing, septic tank and water heater</strong></em></li>
<li><em><strong>Show you where potential problems might develop</strong></em></li>
<li><em><strong>Double-check that past problems have been repaired</strong></em></li>
<li><em><strong>Suggest important upgrades or replacements</strong></em></li>
</ul>
<p><strong>If the inspector raises questions, your insurance company will as well. And, be sure to find out if there is an underground oil storage tank, as many insurers will not provide policies for homes that have one.</strong></p>
<p><span style="color: #ff0000;"><strong><em>13. Estimate How Much It Will Cost to Maintain the House</em></strong></span></p>
<p><strong>Routine maintenance is your responsibility as a homeowner. Losses caused by failing to properly care for your home are not covered by standard homeowners insurance policies. So make sure you factor these costs into the overall price of owning the home.</strong></p>
<p><span style="color: #ff0000;"><strong><em>14. Call Your Insurance Professional</em></strong></span></p>
<p><strong>Don’t wait until the last minute to think about insurance. Ask your insurance professional if the house will qualify for insurance, and get an estimate of the premium. The sooner you act, the smoother the process will be. Don’t be shy about asking for estimates on more than one house. Insurance is an important consideration when purchasing a home. If you are uncomfortable with the cost of insuring a particular house, keep looking for one that better fits your financial situation.</strong></p>

<p style="text-align: justify;"><strong><span style="color: #ff0000;">The coverage is quite straightforward:</span><span style="color: #4579bd;"> if a tree hits a home or other insured structure, such as a detached garage, standard homeowners insurance policies provide coverage for the damage the tree does to the structure and the contents in it. This includes trees felled by wind, lightning or hail.</span></strong></p>

It does not matter whether or not you own the tree; if it lands on your home, you can file a claim with your insurance company.</strong></span></h3>
<p style="text-align: left;"><strong><br />
After a hurricane or windstorm, trees, shrubs and branches can become projectiles capable of traveling significant distances and can cause considerable damage to property. </strong><strong>In most cases, an insurance company is not going to spend time trying to figure out where a tree or other item originally came from.</strong></p>
<p style="text-align: left;"><strong>In some situations where the felled tree was located on a neighbor’s property, the policyholder’s insurance company may try to collect from the neighbor’s insurance company in a process called <span style="color: #000000;">subrogation</span>. This sometimes occurs if the tree was in poor health or not properly maintained. If the insurer is successful, you may be reimbursed for the deductible.</strong></p>
<ul>
<li style="text-align: justify;"><span style="color: #ff0000;"><strong>If a tree hits an insured structure, such as your house or garage, there is also coverage for the cost of removing the tree, generally up to about $500 to $1,000, depending on the insurer and the type of policy purchased. </strong></span></li>
<li style="text-align: justify;"><span style="color: #ff0000;"><strong>If the fallen tree did not hit an insured structure, there is generally no coverage for debris removal. </strong></span></li>
<li style="text-align: justify;"><span style="color: #ff0000;"><strong>However, some insurance companies may pay for the cost of removing the felled tree if it is blocking a driveway or a ramp designed to assist the handicapped.</strong></span></li>

Coverage for these disasters is generally limited to up to 5 percent of the amount of insurance on the structure of the house. Generally, most insurers will limit the coverage to about $500 for any one tree, shrub or plant. Trees and plants grown for business purposes require a separate business insurance policy.</strong></p>

<p><strong>NEW YORK, March 13, 2017—</strong>About one of every 15 U.S. homeowners insurance policyholders files a claim each year and these claimants are now giving insurers their highest ever satisfaction ratings, according to the <a target="_blank" href="http://www.iii.org/" rel="noopener" data-saferedirecturl="https://www.google.com/url?hl=en&amp;q=http://www.iii.org&amp;source=gmail&amp;ust=1492563796203000&amp;usg=AFQjCNGAZp2iUgjt1Lpi3ludiM6cOZqx6g">Insurance Information Institute</a> <span class="m_-4669421518960362857print-footnote">[1]</span> (I.I.I.).</p>
<p>&nbsp;</p>
<p>The J.D. Power 2017 <a target="_blank" href="http://www.jdpower.com/press-releases/jd-power-2017-us-property-claims-satisfaction-study" rel="noopener" data-saferedirecturl="https://www.google.com/url?hl=en&amp;q=http://www.jdpower.com/press-releases/jd-power-2017-us-property-claims-satisfaction-study&amp;source=gmail&amp;ust=1492563796203000&amp;usg=AFQjCNF2VghN4iyUq8YltjIAOLMgAkOHkA">U.S. Property Claims Satisfaction Study</a> <span class="m_-4669421518960362857print-footnote">[2]</span> gives U.S. home insurers a record score of 859 (on a 1,000-point scale). The industry’s cumulative score stood at 846 in 2016. Five factors are considered when assessing policyholder satisfaction: settlement; first notice of loss; estimation process; service interaction; and repair process.</p>
<p>&nbsp;</p>
<p>“Insurers are the nation’s economic first responders and, as such, are continually working to improve how they help Americans recover their lives and businesses in the wake of tragedy and catastrophe,” said <a target="_blank" href="https://twitter.com/III_SeanK" rel="noopener" data-saferedirecturl="https://www.google.com/url?hl=en&amp;q=https://twitter.com/III_SeanK&amp;source=gmail&amp;ust=1492563796203000&amp;usg=AFQjCNF5reUjZj2L80W0XWtzLqJEHsG-Rw">Sean Kevelighan</a> <span class="m_-4669421518960362857print-footnote">[3]</span>, president and chief executive officer (CEO) of the Insurance Information Institute (I.I.I.). “This year’s J.D. Power and Associates survey results are a clear reflection that the industry’s hard work and dedication are delivering the intended results.”</p>

<p>These all-time high claims satisfaction scores are even more remarkable given that incurred losses and loss-adjustment expenses for U.S. property/casualty (P/C) insurers <a target="_blank" href="http://www.iii.org/article/commentary-on-first-nine-months-2016-results" rel="noopener" data-saferedirecturl="https://www.google.com/url?hl=en&amp;q=http://www.iii.org/article/commentary-on-first-nine-months-2016-results&amp;source=gmail&amp;ust=1492563796203000&amp;usg=AFQjCNHO_VcMtgrY0CKaznWdZxgfwCWA_g">grew by 7.6 percent</a> <span class="m_-4669421518960362857print-footnote">[4]</span> year-over-year when comparing the first nine months of 2016 to the first nine months of 2015, according to an analysis developed by Dr. Steven Weisbart, the I.I.I.’s chief economist.</p>
<p>&nbsp;</p>
<p>Incurred losses reflect the dollar amount of a home insurer’s claim payout whereas a loss adjustment expense is the sum an insurer pays for investigating and settling claims, including the cost of defending a lawsuit in court.</p>
<p>&nbsp;</p>
<p>Moreover, Dr. Weisbart noted, catastrophe-related claims through the first nine months of 2016 were already at their highest level since 2012—the year of Superstorm Sandy—and the fourth quarter of 2016 pushed those numbers even higher after insured claim payouts from October 2016’s Hurricane Matthew.</p>

<p>The federal government agreed that 2016 was a volatile, and costly one, estimating 15 separate weather and climate events last year caused more than $1 billion in economic losses, not all of them insured, according to the <a target="_blank" href="https://www.ncdc.noaa.gov/billions/" rel="noopener" data-saferedirecturl="https://www.google.com/url?hl=en&amp;q=https://www.ncdc.noaa.gov/billions/&amp;source=gmail&amp;ust=1492563796203000&amp;usg=AFQjCNH2T5F2QhLtTfbt4SEL4mmMjpyQ1A">National Oceanic and Atmospheric Administration</a> <span class="m_-4669421518960362857print-footnote">[5]</span> (NOAA).</p>
<p>&nbsp;</p>
<p>“Property and casualty insurers have redoubled their efforts to improve the settlement process and fine-tune their customer interactions, efforts that have been clearly recognized and appreciated by homeowners who experienced significant losses this past year,” J.D. Power said.</p>
<p>&nbsp;</p>
<p>The study also noted opportunities for improvement, most notably in water-related and other complex claims that take a long time to settle and that cause significant lifestyle disruption. J.D. Power noted, “Insurers that manage to get the settlement process and customer interaction equation right in these types of disruptive and often catastrophic scenarios are those that raise the bar for the industry.”</p>
<p>&nbsp;</p>
<p>The study is based on more than 6,600 responses from homeowner’s insurance customers, and was fielded between January and November 2016.</p>

<h2>Disasters That Are Not Covered</h2>
<h3>1. Floods</h3>
<p>Flood damage is excluded under standard homeowners and renters insurance policies. Flood coverage, however, is available in the form of a separate policy both from the <a href="http://www.floodsmart.gov/" type="Url">National Flood Insurance Program</a> &#8211; NFIP ( 888-379-9531) and from a few private insurers.</p>
<p>You can get replacement cost coverage for the structure of your home, but only actual cash value coverage is available for your possessions. There may also be limits on coverage for furniture and other possessions stored in your basement.</p>
<p>Flood insurance is available for renters as well as homeowners. You will need flood insurance if you live in a designated flood zone. But also consider buying it if your house could be flooded by melting snow, an overflowing creek or water running down a steep hill. Don’t wait until the evening news announces a flood season warning to buy a policy. There is a 30-day waiting period before federal flood coverage takes effect.</p>
<h3>2. Earthquakes</h3>
<p>Earthquake coverage can be a separate policy or an endorsement to your homeowners or renters policy. It available from most insurance companies. In California, it is also available from the <a href="http://www.earthquakeauthority.com/" type="Url">California Earthquake Authority</a>. In earthquake prone states like California, the policy comes with a high deductible.</p>
<h3>3. Maintenance damage</h3>
<p>It is your responsibility to take reasonable precautions to protect your home from damage. Your insurance policy will not cover damage due to lack of maintenance, mold, termite infestation and infestation from other pests.</p>

<h3>4. SEWER BACK-UP</h3>
</div>
<div>Sewer backups or the inability of sump pumps to handle runoff water from major downpours are not covered under a typical homeowners insurance policy, nor are they covered by flood insurance. Those types of coverage must be purchased either as a separate product or as an endorsement to a homeowners policy.”</div>

<p>The price you pay for your homeowners insurance can vary by hundreds of dollars, depending on the insurance company you buy your policy from. Here are some things to consider when buying homeowners insurance.</p>

<h2><a class="jump-a-hide"></a>Shop around</h2>
<p>It&#8217;ll take some time, but could save you a good sum of money. Ask your friends, check the Yellow Pages or contact your state insurance department. (Phone numbers and Web sites are on the back page of this brochure.) National Association of Insurance Commissioners (<a href="http://www.naic.org/">www.naic.org</a>) has information to help you choose an insurer in your state, including complaints. States often make information available on typical rates charged by major insurers and many states provide the frequency of consumer complaints by company.</p>
<p>Also check consumer guides, insurance agents, companies and online insurance quote services. This will give you an idea of price ranges and tell you which companies have the lowest prices. But don&#8217;t consider price alone. The insurer you select should offer a fair price and deliver the quality service you would expect if you needed assistance in filing a claim. So in assessing service quality, use the complaint information cited above and talk to a number of insurers to get a feeling for the type of service they give. Ask them what they would do to lower your costs.</p>
<p>Check the financial stability of the companies you are considering with rating companies such as A.M. Best (<a href="http://www.ambest.com/">www.ambest.com</a>) and Standard &amp; Poor’s (<a href="http://www.standardandpoors.com/ratings">www.standardandpoors.com/ratings</a>) and consult consumer magazines. When you&#8217;ve narrowed the field to three insurers, get price quotes.</li>

<h2><a class="jump-a-hide"></a>Raise your deductible</h2>
<p>Deductibles are the amount of money you have to pay toward a loss before your insurance company starts to pay a claim, according to the terms of your policy. The higher your deductible, the more money you can save on your premiums. Nowadays, most insurance companies recommend a deductible of at least $500. If you can afford to raise your deductible to $1,000, you may save as much as 25 percent. Remember, if you live in a disaster-prone area, your insurance policy may have a separate deductible for certain kinds of damage. If you live near the coast in the East, you may have a separate windstorm deductible; if you live in a state vulnerable to hail storms, you may have a separate deductible for hail; and if you live in an earthquake-prone area, your earthquake policy has a deductible.</li>

<h2><a class="jump-a-hide"></a>Don’t confuse what you paid for your house with rebuilding costs</h2>
<p>The land under your house isn&#8217;t at risk from theft, windstorm, fire and the other perils covered in your homeowners policy. So don&#8217;t include its value in deciding how much homeowners insurance to buy. If you do, you will pay a higher premium than you should.</li>
<li>
<h2><a class="jump-a-hide"></a>Buy your home and auto policies from the same insurer</h2>
<p>Some companies that sell homeowners, auto and liability coverage will take 5 to 15 percent off your premium if you buy two or more policies from them. But make certain this combined price is lower than buying the different coverages from different companies.</li>
<li>
<h2><a class="jump-a-hide"></a>Make your home more disaster resistant</h2>
<p>Find out from your insurance agent or company representative what steps you can take to make your home more resistant to windstorms and other natural disasters. You may be able to save on your premiums by adding storm shutters, reinforcing your roof or buying stronger roofing materials. Older homes can be retrofitted to make them better able to withstand earthquakes. In addition, consider modernizing your heating, plumbing and electrical systems to reduce the risk of fire and water damage.</li>
<li>
<h2><a class="jump-a-hide"></a>Improve your home security</h2>
<p>You can usually get discounts of at least 5 percent for a smoke detector, burglar alarm or dead-bolt locks. Some companies offer to cut your premium by as much as 15 or 20 percent if you install a sophisticated sprinkler system and a fire and burglar alarm that rings at the police, fire or other monitoring stations. These systems aren&#8217;t cheap and not every system qualifies for a discount. Before you buy such a system, find out what kind your insurer recommends, how much the device would cost and how much you&#8217;d save on premiums.</li>
<li>
<h2><a class="jump-a-hide"></a>Seek out other discounts</h2>
<p>Companies offer several types of discounts, but they don&#8217;t all offer the same discount or the same amount of discount in all states. For example, since retired people stay at home more than working people they are less likely to be burglarized and may spot fires sooner, too. Retired people also have more time for maintaining their homes. If you&#8217;re at least 55 years old and retired, you may qualify for a discount of up to 10 percent at some companies. Some employers and professional associations administer group insurance programs that may offer a better deal than you can get elsewhere.</li>

<h2><a class="jump-a-hide"></a>Maintain a good credit record</h2>
<p>Establishing a solid credit history can cut your insurance costs. Insurers are increasingly using credit information to price homeowners insurance policies. In most states, your insurer must advise you of any adverse action, such as a higher rate, at which time you should verify the accuracy of the information on which the insurer relied. To protect your credit standing, pay your bills on time, don&#8217;t obtain more credit than you need and keep your credit balances as low as possible. Check your credit record on a regular basis and have any errors corrected promptly so that your record remains accurate.</li>
<li>
<h2><a class="jump-a-hide"></a>Stay with the same insurer</h2>
<p>If you&#8217;ve kept your coverage with a company for several years, you may receive a special discount for being a long-term policyholder. Some insurers will reduce their premiums by 5 percent if you stay with them for three to five years and by 10 percent if you remain a policyholder for six years or more. But make certain to periodically compare this price with that of other policies.</li>

<h2><a class="jump-a-hide"></a>Review the limits in your policy and the value of your possessions at least once a year</h2>
<p>You want your policy to cover any major purchases or additions to your home. But you don&#8217;t want to spend money for coverage you don&#8217;t need. If your five-year-old fur coat is no longer worth the $5,000 you paid for it, you&#8217;ll want to reduce or cancel your floater (extra insurance for items whose full value is not covered by standard homeowners policies such as expensive jewelry, high-end computers and valuable art work) and pocket the difference.</li>

<h2><a class="jump-a-hide"></a>Look for private insurance if you are in a government plan</h2>
<p>If you live in a high-risk area &#8212; say, one that is especially vulnerable to coastal storms, fires, or crime &#8212; and have been buying your homeowners insurance through a government plan, you should check with an insurance agent or company representative or contact your state department of insurance for the names of companies that might be interested in your business. You may find that there are steps you can take that would allow you to buy insurance at a lower price in the private market.</li>

<h2><a class="jump-a-hide"></a>When you’re buying a home, consider the cost of homeowners insurance</h2>
<p>You may pay less for insurance if you buy a house close to a fire hydrant or in a community that has a professional rather than a volunteer fire department. It may also be cheaper if your home’s electrical, heating and plumbing systems are less than 10 years old. If you live in the East, consider a brick home because it&#8217;s more wind resistant. If you live in an earthquake-prone area, look for a wooden frame house because it is more likely to withstand this type of disaster. Choosing wisely could cut your premiums by 5 to 15 percent.</p>
<p>Check the CLUE (Comprehensive Loss Underwriting Exchange) report of the home you are thinking of buying. These reports contain the insurance claim history of the property and can help you judge some of the problems the house may have.</p>
<p>Remember that flood insurance and earthquake damage are not covered by a standard homeowners policy. If you buy a house in a flood-prone area, you&#8217;ll have to pay for a flood insurance policy that costs an average of $400 a year. The Federal Emergency Management Agency provides useful information on flood insurance on its Web site at <a href="http://old.iii.org/media/publications/brochures/twelveways/">www.fema.gov/nfip/</a>. A separate earthquake policy is available from most insurance companies. The cost of the coverage will depend on the likelihood of earthquakes in your area. In California the California Earthquake Authority (<a href="http://www.earthquakeauthority.com/">www.earthquakeauthority.com</a>) provides this coverage.</li>
</ol>
<p>If you have questions about insurance for any of your possessions, be sure to ask your agent or company representative when you&#8217;re shopping around for a policy. For example, if you run a business out of your home, be sure to discuss coverage for that business. Most homeowners policies cover business equipment in the home, but only up to $2,500 and they offer no business liability insurance. Although you want to lower your homeowners insurance cost, you also want to make certain you have all the coverage you need.</p>

<h2><a class="jump-a-hide"></a>Overview</h2>
<p>Almost 90 million dogs are owned as pets in the United States according to a 2017-2018 survey by the American Pet Products Association.</p>
<p>According to the <a target="_blank" href="https://www.cdc.gov/features/dog-bite-prevention/index.html" rel="noopener">Centers for Disease Control and Prevention</a>, about 4.5 million people are bitten by dogs each year. Among children, the rate of dog-bite–related injuries is highest for those 5 to 9 years old. Over half of dog-bite injuries occur at home with dogs that are familiar to us.</p>
<p>Homeowners and renters insurance policies typically cover dog bite liability legal expenses, up to the liability limits (typically $100,000 to $300,000). If the claim exceeds the limit, the dog owner is responsible for all damages above that amount.</p>
<h2><a class="jump-a-hide"></a>Dog bite liability and homeowners insurance</h2>
<p>Some insurance companies will not insure homeowners who own certain breeds of dogs categorized as dangerous, such as pit bulls. Others decide on a case-by-case basis, depending on whether an individual dog, regardless of its breed has been deemed vicious. Some insurers do not ask the breed of a dog owned when writing or renewing homeowners insurance and do not track the breed of dogs involved in dog bite incidents. However, once a dog has bitten someone, it poses an increased risk. In that instance, the insurance company may charge a higher premium, nonrenew the homeowner’s insurance policy or exclude the dog from coverage.</p>
<p>Some insurers are taking steps to limit their exposure to such losses. Some companies require dog owners to sign liability waivers for dog bites, while others charge more for owners of breeds such as pit bulls and Rottweilers and others are not offering insurance to dog owners at all. Some will cover a pet if the owner takes the dog to classes aimed at modifying its behavior or if the dog is restrained with a muzzle, chain or cage.</p>
<h2><a class="jump-a-hide"></a>Homeowners insurance liability claims</h2>
<ul>
<li>Homeowners insurers paid out over $686 million in liability claims related to dog bites and other dog-related injuries in 2017, according to the Insurance Information Institute (I.I.I.) and State Farm®.</li>
<li>An analysis of homeowners insurance data by the I.I.I. found that the number of dog bite claims nationwide increased to 18,522 in 2017 compared to 18,123 in 2016—a 2.2 percent increase.</li>
<li>The average cost per claim for the year increased by 11.5 percent. The average cost paid out for dog bite claims nationwide was $37,051 in 2017, compared with $33,230 in 2016. The average cost per claim nationally has risen more than 90 percent from 2003 to 2017, due to increased medical costs as well as the size of settlements, judgments and jury awards given to plaintiffs, which are trending upwards.</li>
<li>California continued to have the largest number of claims in the United States, at 2,228 in 2017, an increase from 1,934 in 2016. The state with the second highest number of claims was Florida at 1,345. Florida had the highest average cost per claim at $44,700. The trend in higher costs per claim is attributable not only to dog bites but also to dogs knocking down children, cyclists, the elderly, etc., which can result in injuries that impact the potential severity of the losses.</li>
</ul>
<h2><a class="jump-a-hide"></a>State and local legislation</h2>
<p>Dog owners are liable for injuries their pets cause if the owner knew the dog had a tendency to bite. In some states, statutes make the owners liable whether or not they knew the dog had a tendency to bite; in others, owners can be held responsible only if they knew or should have known their dogs had a propensity to bite. Some states and municipalities have “breed specific” statutes that identify breeds such as pit bulls as dangerous; in others individual dogs can be designated as vicious. At least two states, Pennsylvania and Michigan, have laws that prohibit insurers from canceling or denying coverage to the owners of particular dog breeds. In Ohio, for example, owners of dogs that have been classified as vicious are required to purchase at least $100,000 of liability insurance.</p>
<p>The American Kennel Club reports that while many municipalities have enacted bans on specific breeds, several states have laws barring municipalities and counties from targeting individual breeds.</p>
<ul>
<li><strong>Dog owners’ liability:</strong> There are three kinds of law that impose liability on owners:<br />
1) A dog-bite statute: where the dog owner is automatically liable for any injury or property damage the dog causes without provocation.<br />
2) The one-bite rule: where the dog owner is responsible for an injury caused by a dog if the owner knew the dog was likely to cause that type of injury—in this case, the victim must prove the owner knew the dog was dangerous.<br />
3) Negligence laws: where the dog owner is liable if the injury occurred because the dog owner was unreasonably careless (negligent) in controlling the dog.</li>
<li><strong>Criminal penalties:</strong> On January 26, 2001, two Presa Canario dogs attacked and killed Diane Whipple in the doorway of her San Francisco, California, apartment. Marjorie Knoller, the owner of the dogs, was convicted of involuntary manslaughter for keeping a mischievous dog that killed a person. She was sentenced to four years in prison for involuntary manslaughter and was ordered to pay $6,800 in restitution. Her husband, Robert Noel, was convicted on lesser charges but also received a four-year prison sentence. Knoller became the first Californian convicted of murder for a dog’s actions. This was only the third time such charges have been upheld in the United States, the first coming in Kansas in 1997.</li>
